Instructing Us

2DRJ Barristers Can Be Instructed In The Folowing Ways:

Please follow the link for further information on how you can instruct a barrister directly without the need to use a solicitor.

  • Publicly funded (also known as Legal Aid) – Legal Aid can only be accessed using the services of a solicitor because of the strict eligibility criteria and application process.

Fees

We operate a transparent and open policy when it comes to costs. The cost of instructing a barrister will vary depending in the nature of the case, the seniority of counsel, and duration of the court hearing.

Our experienced team of clerks can discuss the fee options available and agree a fee in advance of work being commenced. We will ensure that fee quotations are provided within a reasonable time, and in clear and readily understandable terms.

Pricing Models Include:

  • Brief Fee: This is a fixed fee which covers preparation for a trial and the first day. At the time of instruction a ‘refresher fee’ is also agreed upon; this is a fixed fee for each subsequent day of the trial (which includes ongoing preparation).
  • Fixed Fee: This is a set amount of money for the work being undertaken. There may also be circumstances where additional fees apply, but these will be identified and agreed upon in advance to ensure transparency of costs at all times.
  • Hourly Rate: An hourly rate and maximum number of hours can be agreed in advance.

Any estimates for fees will make it clear which pricing model applies. If it not possible to estimate the final figure to be charged, our clerks will provide full details of how the fee is calculated – e.g., hourly rate, capped fees, paperwork rates, preparatory/advocacy rates, and the work undertaken will not exceed a specified amount without prior approval of the client.

Please note that VAT applies to fees charged in all cases. In some limited circumstances a VAT exemption may apply, which you will be advised of by our clerks.

Timescales

The timescale for completion of work may depend on several factors:

  • barrister’s availability;
  • availability of the client or relevant third parties;
  • complexity of the case;
  • volume of papers the barrister needs to review;
  • the need for additional information or documents;
  • the approach taken by the other side;
  • third parties intervening in the case; and
  • court waiting times.

Should representation or advice be needed at short notice, please contact our clerking team who will be able to discuss your requirements who, in the majority of circumstances, will be able to arrange urgent representation.
