Olivia Chessell, led by Rupert Bowers KC of 2 Hare Court Chambers and instructed by Jodie Dennison of Stryders Solicitors, has secured an acquittal for a youth defendant charged with Attempted Murder following a six-week trial at St Alban’s Crown Court.
The Crown’s case was that the 16-year-old defendant was responsible for organising the attempted murder of another drug dealer. Evidence presented at trial was said to show him recruiting others to carry out the knife attack, giving orders and providing the weapons, although he was never at the scene of the attack. The Crown put its case as a joint enterprise attempted murder of drug dealer X, and that those who carried out the attack had caused life-threatening injuries to person Y instead.
Legal argument advanced at trial on the defendant’s behalf dealt with principles of transferred malice, joint enterprise and secondary party liability where self-defence is raised by the principal.
